Representative Litigation and Arbitration Matters

Mr. Morin has extensive experience in business litigation and arbitration and he has served as a principal or lead counsel on hundreds of matters during the course of his career, including the following:

  • The FDIC in the United States’ largest bank failure
  • A Dutch industrial corporation (the 27th largest in the world at the time) and its U.S. subsidiary (which was itself a “Fortune 100” Company) in antitrust and dealer/franchise litigation
  • Swedish and Finnish industrial corporations in licensing and contract litigation
  • A German engineering firm in, among other matters, a construction and process engineering arbitration against the largest gold mining company in the United States
  • One of the world’s largest pharmaceutical companies in products liability and contract litigation
  • A New York City agency in personal injury defense
  • A U.S. company in a licensing dispute involving the athletic footwear industry
  • A Hong Kong-based company in a litigation involving the fashion and sports headwear industry
  • A Bahamian company involved in a commercial dispute concerning the development of a mega-yacht and condominium complex
  • A family dispute among German Counts and Countesses in a litigation in the United States that ended with a dismissal on forum non conveniens grounds.

In addition, he has been involved in insurance litigation, contested probate matters, RICO, accounting and legal malpractice, banking, real estate, alcohol beverage law, securities law and trade regulation. During his more than four decades as a lawyer, Mr. Morin’s practice has taken him to four continents, a dozen countries, thirty states and some  one-hundred and twenty-five cities around the world.

Representative Trials & Arbitration

Mr. Morin has been the lead or co-lead attorney in some 60 trials and arbitration hearings, including the following:

  • Representing a German Engineering and Construction firm in a multi-week arbitration under the auspices of the International Chamber of Commerce against the largest gold mining company in the United States
  • Representing one of the largest corporations in the Netherlands and its Fortune 100 affiliate in a two-week trial against 13 of their U.S. sales agents involving the sale of small business computers, in the U.S. District Court for the Southern District of New York
  • Representing the same Dutch/U.S. companies in an antitrust suit tried in the U.S. District Court for the Southern District of New York
  • Representing a U.S. subsidiary of one of the largest pharmaceutical companies in the world in a two-week wrongful death/products liability trial in the Southern District of New York
  • Representing the U.S. affiliate of an Italian real estate company in a 42-day arbitration before the American Arbitration Association involving a dispute concerning a real estate development project in Massachusetts
  • Representing the buyer of a high-tech company in a 21-day securities fraud arbitration before the American Arbitration Association
  • Representing a manufacturing company in a lengthy trial in the U.S. District Court for the Eastern District of New York in an employment dispute with a senior executive following the sale of the business
  • Representing a Cardio-thoracic surgeon in a $100 Million contract dispute with another surgeon in the Supreme Court of the State of New York (Nassau County)
  • Representing a seller of a 15th Century Venetian sculpture against a New York City art gallery that refused to make full payment in a week-long trial in the U.S. District Court for the Southern District of New York
  • Representing a Swedish/Finnish conglomerate in a trial in the U.S. District Court for the Western District of Wisconsin against one of the largest paper making companies in the United States arising out of the latter’s breach of a license agreement
  • Representing a Nigerian oil services company in an arbitration in New York, before the National Association of Securities Dealers, involving a claim against a well-known New York-based investment bank
  • Representing an Estate in a Surrogate’s Court trial in New York County involving the ownership of a Jackson Pollack painting, in which the losing party (his opponent) appealed (unsuccessfully) to the Appellate Division (First Department), and the New York Court of Appeals and also sought (unsuccessfully) Certiorari to the United States Supreme Court
  • Representing the beneficiaries of a will that was challenged (unsuccessfully) in the Surrogate’s Court in Westchester County, New York, in which the plaintiff alleged the incompetence of the testator and undue influence by family members
  • Representing a Co-trustee Bank in a Surrogate’s Court trial in Fulton County, New York
  • Representing a high-tech company from Maryland in a contract dispute with a Xerox subsidiary in the U.S. District Court for the Southern District of New York involving the concept of “termination for convenience”
  • Representing various individuals and corporate plaintiffs in tax-related disputes with the IRS, three of which were tried in the U.S. Tax Court, and one of which was tried in the U.S. District Court for the District of South Dakota
  • Representing residents and a New Jersey municipality in an 11-day zoning trial against a developer which the residents and municipality eventually won in a New Jersey appellate court
  • Representing an architecture firm in a week-long trial in Supreme Court (New York County) defeating a wrongful termination claim by a former employee
  • Representing the subsidiary of a German business in a combined Federal Court litigation/AAA arbitration in Pittsburgh, Pennsylvania involving, among other issues, a breach by a key employee of the “non-compete” clause in his employment agreement
  • Representing a Wisconsin-based company that manufactures and distributes products throughout the world, in a trial in the U.S. District Court for the Eastern District of New York involving employment issues
  • Representing a property owner in the U.S. District Court for the Eastern District of New York in a dispute brought by an artist who sued the property owners for their removal of a 20-foot sculpture of a swan (which the property owners commissioned) that the artist claimed, unsuccessfully, had to be preserved under an arcane federal statute
  • Representing a firm of doctors in an AAA Arbitration in New York City against the owner of the building in midtown Manhattan in which they practiced to determine a “fair rental rate” on renewal of their lease
  • Representing a Florida-based company in an arbitration in New York before the American Arbitration Association involving the termination of employees
  • Representing a foreign investor in a contract dispute in the U.S. District Court for the Southern District of New York
  • Representing a leading American furniture manufacturer at a trial in New York Supreme Court (New York County) involving a dispute with one of its leading designers
  • Representing a business owner in a contract dispute in the Supreme Court in the State of New York (Nassau County)
  • Representing a Westchester County hotel in an administrative trial in which the New York State Liquor Authority sought (unsuccessfully) to suspend the hotel’s liquor license
  • Representing life and health insurance companies in several trials in New York Supreme Court (New York and Queens Counties) involving coverage claims
  • Representing Claimants and Respondents in a variety of AAA arbitrations not referenced above including employment, construction, and breach of contract matters
  • Representing an elderly man in a successful week-long suit against a celebrity dentist for dental malpractice in New York State Supreme Court (New York County)
  • Representing the New York City Housing Authority (a client for which he supervised more than 100 cases) at a trial in New York State Supreme Court (Bronx County) involving a claim of personal injury
  • Representing a family that had been evicted from their apartment in the Landlord/Tenant Court in New York City while serving as a volunteer attorney for the New York Legal Aid Society
