CAREY R. D'AVINO, admitted to bar 1985, New York; 2003, Pennsylvania. U.S. Supreme Court; U.S. Court of Appeals, Second Circuit, Third Circuit, District of Columbia Circuit; U.S. District Court, Southern and Eastern Districts of New York; U.S. Virgin Islands District Court. Mr. D’Avino appeared before the United States Supreme Court on February 28, 2012, to argue Kiobel, et al., v. Royal Dutch Petroleum. The question presented concerned whether federal courts could exercise jurisdiction under the venerable Alien Tort Statute enacted by the First Congress in 1789 to hold corporations liable in tort for violations of customary international law. Mr. D’Avino participated as plaintiffs’ counsel in the multilateral negotiations leading to the historic German and Austrian Holocaust settlement agreements including the Joint Statement establishing the terms of the German Foundation “Remembrance, Responsibility and Future” executed on July 17, 2000, the Joint Statement establishing the terms of the Austrian Fund “Reconciliation, Peace and Cooperation” executed on October 24, 2000, and the Joint Statement establishing the terms of the “Austrian General Settlement Fund” on January 17, 2001. He is an individual signatory executing each of these Holocaust settlement agreements. Mr. D’Avino has advised governments and planned and implemented cross-border commercial transactions for institutional investors, public corporations and high net worth individuals for more than 30 years.
