May, 2014 Partner Lawrence Steckman, acting as plaintiff’s special RICO counsel, defeated defendants’ motions to dismiss for failure to state a RICO claim and for lack of jurisdiction and proper venue. Plaintiff alleged several individuals and their company sent loan documents into New York and made phone calls to plaintiff to induce her to make loans to them which they had no intention of paying back. Plaintiff also alleged successor liability as to a second company. Judge Korman rejected defendants’ jurisdictional and venue arguments and found that successor liability had been properly alleged. Because `defendants had not moved against all plaintiff’s claims, Judge Korman denied defendants’ motion for failure to state a claim as it would involve a “fragmentary disposal” of claims arising from the same complex of facts.
