Martin Garbus Succeeds in Dismissing a Free Speech Case

  • March 2014 EVW Partner Martin Garbus succeeded in dismissing much of a lawsuit which, at its core, is a free speech case. The client obtained access to allegedly confidential information from the Council on American-Islamic Relations Action Network (CAIR) and recorded conversations, which were to be disseminated for a film critical of CAIR. EVW obtained summary judgment, dismissing Federal Wiretap Act and Stored Communications Act claims of one of the two CAIR entity-plaintiffs, and the conspiracy theory, as to those Acts, as well as several other claims.
