EVW Wins Defense Verdict After Two-Week Trial In U.S. District Court In Employment Discrimination Suit

Martin Garbus and Robert Gross won a defense verdict for the CEO of a New York City hospital after a two-week jury trial in the U.S. District Court for the Eastern District of New York.

The case involved multi-million dollar age and race discrimination claims brought under Federal, State and New York City statutes against Wyckoff Heights Medical Center and its CEO, Ramon Rodriguez, by Dr. Addagada Rao, the former chief of surgery. The jury trial was presided over by District Judge Nicholas G. Garaufis.

Among other things, the case presented several fact issues about whether various discriminatory statements were made, requiring the jury to make numerous credibility determinations about the parties themselves and their respective witnesses. The jury verdict was a hard-fought victory for Mr. Garbus and a vindication for EVW’s client.
